Parental Abduction / Kidnapping (VA Code §18.2-47(D)

To be found guilty of Parental Abduction, the prosecution must prove beyond a reasonable doubt that the defendant is a parent, family, or household member of the abducted child, that the defendant used force, intimidation, or deception to seize, take, transport, detain, or hide the child, and that the defendant intended to deprive the child of their personal liberty or to withhold or conceal the child from another parent or authority legally entitled to the child’s charge, and that the defendant acted without legal justification or excuse in violation of a court order issued in a the impending court proceeding. If the abduction occurs in Virginia and the child remains inside the state, such a crime is punishable as a Class-1 misdemeanor. However, if the parent abducts and takes the child outside of Virginia, even to a neighboring state, such conduct is classified as a Class-6 felony– a more serious charge. Regardless of whether a child remains in or outside of Virginia, the court may also punish the defendant as a contempt of court for violating an existing court order regarding the custody of the minor child.
